Please note that Vendor Gate Passes grant access to the Vendor area only. They do not grant admittance to the grandstands. Anyone found in the grandstands without a rodeo ticket may be removed.

No vendor may sell, solicit, give away or distribute alcohol or food without prior approval of the Black Hills Roundup. Violation of this clause will terminate this Vendor Agreement and is just cause for removal of the stand from the Roundup Grounds. Vendor fees are then non-refundable.

*Approved Temporary Food Vendors must fill out the SD Department of Health Temporary Food Service Requirement Checklist and Application. Food Vendors are responsible directly to the SD Department of Health.*

RELEASE AND WAIVER OF LIABILITY FOR VENDORS

This Release and Waiver of Liability is executed this day in 2024, by you the “Vendor” in favor of the Black Hills Roundup and its directors, officers, employees, volunteers, and agents.

I, the Vendor, hereby freely and voluntarily, without duress, execute this Release under the following terms:

1. Waiver and Release. I hereby release and forever discharge and hold harmless the Black Hills Roundup and its successors and assigns from any and all liability, claims, demands, and causes of action, of whatever kind of nature, either in law or equity, which may hereafter arise from my participation with the Black Hills Roundup and/or any project, activity or event sponsored, managed, arranged, or promoted by, or otherwise affiliated or associated with the Black Hills Roundup.

I understand and acknowledge that this Release discharges the Black Hills Roundup from any liability or claim that I may have against the Black Hills Roundup, with respect to any bodily or other injury, illness, death, or property damage that may result from my participation. I also understand that the Black Hills Roundup does not assume any responsibility or obligation to provide financial assistance or other assistance, including, but not limited to, medical, health, or disability insurance, in the event of injury, death, or property damage.

2. Insurance. The Black Hills Roundup does not carry or maintain any health, medical, disability, damage, or other liability insurance coverage for the benefit of its vendors, and expressly disclaims any responsibility or obligation to do so. As a vendor, I am expected and encouraged by the Black Hills Roundup to maintain
medical, health, and all other applicable insurance coverage for my own benefit.

3. Medical Treatment. Except as otherwise agreed to by the Black Hills Roundup in writing, I hereby release and forever discharge the Black Hills Roundup from any and all liability claims, demands, and causes of action whatsoever that may arise on account of any first aid or other medical treatment rendered during my participation with the Black Hills Roundup and/or any project, activity, or event sponsored, managed, arranged, or promoted by, or otherwise affiliated or associated with the Black Hills Roundup.

4. Assumption of Risk. I understand that my participation with the Black Hills Roundup and/or any project, activity, or event sponsored, managed, arranged, or promoted by, or otherwise affiliated or associated with the Black Hills Roundup may include activities that may be hazardous to me. I further recognize and understand that such participation may involve certain inherently dangerous activities. I hereby expressly and specifically assume the risk of injury or harm in the activities and release the Black Hills Roundup from all liability for injury, illness, death, and/or property damage that may result.

5. Photography/Audio Release. I do hereby grant and convey unto the Black Hills Roundup rights, titles, and interest in, and to, any and all photographic images and video or audio recordings made by or on behalf of the Black Hills Roundup, or made with consent, during my participation in the Black Hills Roundup and/or any project, activity or event sponsored, managed, arranged, or promoted by, or otherwise affiliated or associated with the Black Hills Roundup, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.

6. Other. I expressly understand and agree that this Release is intended to be as broad and inclusive as permitted by law, and that this Release shall be governed by and interpreted in accordance with the laws of this state, county, city and/or township. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release.

By accepting, I acknowledge that I have read and understand this Release, and agree to its provisions.

Instructions and Helpful Hints for Vendors

Fill out the Vendor Application completely. Must include Certificate of Insurance.

Please be as accurate as possible with your stand measurements and power requirements. Bumper pull trailers include the trailer tongue for total length. We will place stands according to size and power needs.

There will be a new map of the Vendor sites uploaded to the website as soon as one is available.

The sites inside the fenced Vendor area are for Vendor stands, and their resupply vehicles when necessary, only.

Vendor Gate Passes – While the ticket booths are open Vendor Passes must be worn to access the
Vendor areas. They must be worn while in the Vendor areas. They help us identify who is supposed to
be there. They are not grandstand passes or rodeo tickets. NEW THIS YEAR – On sold-out days we
will be selling Standing Room Only tickets. Only guests with Standing Room Only tickets will be
allowed in those areas.

No trailers under the grandstands, no propane, no generators.

NO DOGS except trained service dogs. Emotional support animals are not service animals.

SETUP - The Vendor Area will close at 5:00pm on the 29th of June for our Sponsor Appreciation Party.
Finish setup before, or the next morning. Vehicle traffic through the party area is not allowed during
this time.

No one may begin to set up without having completed and submitted an Application, Liability Release,
Certificate of Insurance, and payment in full.

Tow Vehicle/Trailer Parking Area – The area outside Gate 2 along the river may be used to park
vehicles and cargo trailers. There are no camper hookups available. Local Campgrounds are Riverside
Campground 605 892 6446 and Wyatt’s Hideaway Campground 605 892 0600.

RAFFLES – The selling of raffle tickets and/or canvassing must be done from your stand.
